1. About this policy

We are Jogiton Online Limited, a company registered in England and Wales under number 15010475 and whose registered office is at Mentor House, Ainsworth Street, Blackburn, Lancashire, BB1 6AY.

This Acceptable Use Policy (the “Policy”) sets out the content standards that apply when you upload content to our Website (Jogiton.com), make contact with other users on our Website, link to our Website, or interact with our Website in any other way.

This Policy forms part of our Terms and Conditions and it is important that you read and understand our Terms and Conditions, which should be read in conjunction with this Policy. 

We reserve the right to change this Policy at any time. Amendments will take effect when posted on our Website. We will try to give you reasonable notice of any major changes.

2. Prohibited Uses

2.1 You may not use our Website:

2.1.3 In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.

2.1.4 For the purpose of harming or attempting to harm minors in any way.

2.1.5 To bully, insult, intimidate or humiliate any person.

2.1.6 To send, knowingly receive, upload, download, use or re-use any material which does not comply with our Content Standards below.

2.1.8 To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

2.1.9 In any way that involves child sexual exploitation or abuse.

2.1.10 To upload terrorist content.

2.2 You also agree:

2.2.1 Not to reproduce, duplicate, copy or re-sell any part of our Website.

2.2.2 Not to conduct, facilitate or permit any text or data mining or web scraping in relation to our Website without our consent in writing.

2.2.3 Not to access without authority, interfere with, damage or disrupt:

(a) any part of our Website;

(b) any equipment or network on which our Website is stored;

(c) any software used in the provision of our Website; or

(d) any equipment or network or software owned or used by any third party.

3. Content Standards

3.1 These Content Standards apply to any and all material which you contribute to our Website (a “Contribution”).

3.5.6 Encourage, promote or provide instructions for an eating disorder or behaviours associated with an eating disorder.

3.5.7 Promote sexually explicit material.

3.5.8 Include child sexual abuse material.

3.5.9 Incite violence or hatred against particular groups.

3.5.10 Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

3.5.11 Include content that would be considered a criminal offence under laws relating to terrorism, child sexual abuse material, racism or zenophobia.

3.5.12 Infringe any copyright, database right or trade mark of any other person.

3.5.13 Include any video content.

3.5.14 Include material that might impair the physical, mental or moral development of persons under the age of 18.

3.5.15 Be likely to deceive any person.

3.5.16 Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.

3.5.17 Contain illegal content or promote any illegal content or activity.

3.5.18 Be in contempt of court.

3.5.19 Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.

3.5.20 Be likely to harass, upset, embarrass, alarm or annoy any other person.

3.5.21 Impersonate any person or misrepresent your identity or affiliation with any person.

3.5.22 Give the impression that the Contribution emanates from Jogiton Online Limited, if this is not the case.

3.5.23 Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.

3.5.24 Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.

3.5.25 Contain any advertising or promote any services or web links to other sites.

4. Breach of this Policy

4.1 When we consider that a breach of this Policy has occurred, we may take such action as we deem appropriate.

4.2 Failure to comply with this Policy constitutes a material breach of our Terms and Conditions and may result in our taking all or any of the following actions:

4.2.1 Immediate, temporary or permanent withdrawal of your right to use our Website and our Services.

4.2.2 Immediate, temporary or permanent removal of any Contribution uploaded by you to ourWebsite.

4.2.3 Issue a warning to you.

4.2.4 Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

4.2.5 Further legal action against you.

4.2.6 Disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

4.3 We exclude our liability for all action we may take in response to breaches of this Policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.
